Schmidt Works to Defend Second Amendment

February 3, 2025

WASHINGTON, DC: Congressman Schmidt today announced he has cosponsored four bills to protect Americans’ Second Amendment right to keep and bear arms.

H.R. 38, the Constitutional Concealed Carry Reciprocity Act, provides nationwide reciprocity for concealed carry license holders and for residents of constitutional carry states.

H.R. 45, the Firearm Industry Non-Discrimination (FIND) Act, prevents any business that discriminates against firearm businesses or associations from contracting or subcontracting with the federal government.

H.R. 404, the Hearing Protection Act (HPA), reduces archaic barriers to purchasing a firearm suppressor.

H.R. 624, the Reining in Federal Licensing Enforcement (RIFLE) Act, protects owners of small gun stores and federal firearms licensees from being forced out of business by the Bureau of Alcohol, Tobacco, Firearms, and Explosives’ (ATF) zero tolerance policy, which was abused by the Biden administration.

“The Constitution is clear that Americans’ Second Amendment rights shall not be infringed,” Congressman Derek Schmidt said. “Sadly, the previous administration mobilized the federal government against law-abiding gun owners and firearm businesses, so we are taking action to prevent future abuses of this constitutional right.”

Schmidt specifically highlighted the Constitutional Concealed Carry Reciprocity Act:

“I’m particularly proud to cosponsor the Constitutional Concealed Carry Reciprocity Act, which builds upon the work I did as Attorney General to expand the number of states that recognize Kansas concealed carry permits,” Congressman Schmidt continued. “Americans should be able to freely exercise their constitutional rights no matter which state they’re in. I’m confident these bills, which reduce burdensome regulations and strengthen congressional oversight of federal agencies, will make a meaningful difference in protecting Kansans’ right to bear arms.”

BACKGROUND

The Constitutional Concealed Carry Reciprocity Act, Introduced by Congressman Richard Hudson (NC-09)

H.R. 38 amends current law to allow citizens with state-issued concealed carry licenses or permits to conceal a handgun in any other state. It also allows residents of constitutional carry states to carry in other states.

The FIND ACT

Large financial institutions and other corporations, many of whom benefit from federal contracts, have increasingly adopted policies designed to hurt the domestic firearm industry, from forcing the industry to restrict the products sold to refusing to work with the industry. H.R. 45 fights back against this “boardroom gun control” by prohibiting the federal government from entering into contracts with any entity that discriminates against the firearm and ammunition industry.

The HPA

H.R. 404 reclassifies silencers and removes them from the legal definition of firearm, making it easier for law-abiding gun owners to protect their hearing while enjoying recreational activities.

The RIFLE Act

H.R. 624 clearly defines and strengthens what constitutes a willful violation of federal law and ensures the ATF works with federal firearms licensees, giving them a chance to comply before the ATF moves to revoke a license. The legislation also automatically reinstates and approves licenses suspended, revoked, or denied while the ATF’s zero tolerance policy is in effect and establishes a website to administer reimbursement claims.
